HHS asks judge to dismiss ACC's disclosure lawsuit

The Department of Health and Human Services has asked a federal judge to dismiss the American Chemistry Council's lawsuit seeking disclosure of documents that explain how HHS staff decided to list formaldehyde in its most recent Report on Carcinogens. The ACC is seeking summary judgment in its favor on claims that HHS has repeatedly denied the ACC's document requests through the Freedom of Information Act.
