The Justice Department used the Financial Institutions Reform, Recovery, and Enforcement Act in two cases this year that would typically be handled by the Securities and Exchange Commission. "This creates a potential turf battle," said Brian Feldman, a former assistant U.S. attorney. "It creates competition between the SEC and the Justice Department on who takes the lead on a civil case."
