Top court allows N.Y. Internet sales tax to stand

The U.S. Supreme Court passed on hearing a case involving New York state's sales tax on Internet retailers, which requires online retailers to collect tax even absent a presence in the state. The decision, from the New York Court of Appeals, says online retailers such as Amazon have a local presence in the state because of their affiliated sites and providers. "[I]t may be that the physical presence test is outdated" and a new test is needed, Chief Judge Jonathan Lippman wrote in March.
