The Supreme Court has been asked to weigh in on the class-action status of two cases that allege front-loading washing machines are susceptible to developing mold. "The key issue is whether a product defect case can proceed as a class action even if a majority of class member purchasers have not experienced any problem. The 6th and 7th Circuit's decisions suggest that they can," write Desmond Hogan and Erica Songer. This issue is "fundamental for the future of products liability litigation," they add.
