Case may provide further clarity on the FCPA

A case before a federal appeals court could provide additional clarity with regard to the Foreign Corrupt Practices Act. The case involves two executives who were convicted of participating in a plan to bribe a telecommunications company in Haiti. At issue is whether the telecom company, which is state-owned, is an "instrumentality" of a foreign official.
