A California woman who challenged the state's capital punishment system in federal district court on the grounds that it produced arbitrary results did not use that argument in state court and therefore cannot use it in federal court, a panel of the US Court of Appeals for the 9th Circuit has ruled. The ruling reinstated a death sentence the woman received for a 1990 murder.
