Federal appeals court rules in favor of surety on bond because of "pay-if-paid" clause

A federal appeals court has upheld a lower court's decision that a surety was not liable under a payment bond in a case involving a "pay-if-paid" clause. In the case, which involved the construction of a facility for manufacturing automobile transmissions, a second-tier subcontractor filed a lawsuit seeking payment after the owner filed for bankruptcy.
