Michigan court ruling could increase insurance premiums

A recent Michigan Court of Appeals ruling to prohibit the use of credit-based insurance scoring could increase insurance premiums and have a negative effect on consumers. PCI strongly disagrees with the decision in the Insurance Institute of Michigan et al v. PCI voices disappointment with Rhode Island court ruling

PCI expressed its disappointment last week with a ruling by a Rhode Island Superior Court judge that would require every insurance carrier authorized to sell motor vehicle liability insurance in the state to conduct a labor rate survey and use this information as the sole determinant of the prevailing auto body repair labor rate. The case, Auto Body Association of Rhode Island (ABARI) vs. State of Rhode Island Department of Business Regulation (DBR), stems from the department's interpretation of Rhode Island law that the labor rate survey is not the sole determinant of the prevailing labor rate. Iowa Insurance Division rescinds rebate bulletin

PCI is pleased by the Iowa Insurance Division's decision to rescind Rebate Bulletin 08-11, which would have encouraged the introduction of unnecessary legislation prohibiting insurers from offering any goods or services not specifically incorporated in the policy. PCI delivered an all-industry letter and joined a number of industry members at a public hearing on Aug. 15 to voice concerns about the bulletin being overly restrictive. Insurance Commissioner Susan Voss announced she will rescind the rebate bulletin and begin to prepare a subsequent bulletin, which is expected by Aug. 29. PCI Cautions Higher Gas Prices May Not Lead to Lower Insurance Claims

Based on a new paper released by PCI, public policymakers should be cautious in isolating one factor such as the number of miles driven and then concluding auto insurance premiums should be reduced. "While there is solid evidence the high price of gas has reduced the number of miles driven, it would be a mistake to assume this means there will be lower insurance claims reporting and as a result, lower insurance premiums for consumers," said Paul Magaril, regional manager and counsel for PCI.
