Australia's Labor Party reportedly plans to propose an amendment to the U.S. free trade agreement that would require forfeiture of profits for drug companies that file spurious patent claims to block generic products from coming to market. Under Labor's plan, expected to be offered in Parliament this week, the drug companies also could be forced to refund the extra costs incurred by the Pharmaceutical Benefits Scheme as a result of drug prices remaining higher.
