Today, the U.S. Supreme Court hears arguments in a Montgomery, Md., case over who bears the burden of proof in disputes concerning the adequacy of special education plans for children with special needs. While the Individuals with Disabilities Education Act does not address which party--parents or schools--must prove a particular education plan would work, the most recent lower-court ruling placed the burden on the party initiating legal proceedings.
