A three-judge panel of a federal appeals court in Cincinnati has resurrected a legal challenge to NCLB by voting 2 to 1 to reverse a Detroit judge's dismissal of the case. National Education Association affiliates in several states and school districts in three states filed the 2005 lawsuit, subsequently dismissed the same year, saying schools should not be forced to spend local money in complying with the federal law's mandates.
