The 3rd U.S. Circuit Court of Appeals reviewed a case in which 6,400 former insurance agents accuse a carrier of switching them from employees to independent contractors, violating several employment and age-discrimination laws. The Equal Employment Opportunity Commission said the insurer retaliated against 19 agents who refused to sign releases that required them to continue working as contractors and barred them from suing on the grounds of discrimination. The insurance company contends that the measures were a legal means of cutting its costs.
