In a victory for the U.S. airline industry, the English High Court of Justice said Thursday it would refer to the European Court of Justice a legal challenge to Europe's Emissions Trading Scheme. The Air Transport Association and three member carriers filed suit against the plan last December, arguing that it violates international treaties and is "contrary to the customary international law principle that each state has complete and exclusive sovereignty over the airspace above its territory." An ATA executive said including international airlines in the European emissions plan "clearly stands in the way of an appropriate and effective global solution."
