GOP senators are backing court filings that challenge President Barack Obama's recess appointments to the National Labor Relations Board in January. "We will demonstrate to the Court how the President's unconstitutional actions fundamentally endanger the Congress's role in providing a check on the excesses of the executive branch," said Minority Leader Mitch McConnell of Kentucky. Should the courts find the appointments unconstitutional, the NLRB will have only two members of the required five, and won't be able to enact rules and enforce federal labor laws.
