A U.S. District Court judge rejected Natural Chem Holdings' appeal over the auction sale of the idled New Energy ethanol plant in South Bend, Ind., to Maynards Industries and Biditup Auctions Worldwide. New Energy, which also bid for the facility, claimed that the two companies joined the auction separately and teamed up later to win the bidding. A bankruptcy court judge in February ruled that Maynards and Biditup's acquisition of the plant violated no laws.
