Judge William Thomas could become the first openly gay black man to sit on the federal bench, but so far Sen. Marco Rubio, R-Fla., has blocked the Senate from holding a confirmation hearing for the nominee. Rubio is said to be concerned about a sentence that Thomas handed down in a case in Florida, but other judges have come to Thomas' defense, saying he handled the case properly. Thomas was nominated for the federal bench by President Barack Obama in November.
