Standard & Poor's likely will claim that a lawsuit by the Justice Department relating to the credit crisis is retribution for a downgrade of U.S. credit. However, the rating agency is expected to have trouble getting access to government records to help make the case, according to some legal experts. "It is important that the government be able to conduct investigations confidentially to protect the subjects of investigations who may never be charged," said former federal prosecutor Wayne Gross.
