A California appellate court overturned a felony theft conviction of an insurance agent for selling a fixed annuity to a client with dementia. The court said that the failure of the agent to recognize the woman's dementia didn't constitute theft. This article suggests that advisers assess the mental state of elderly clients by asking a series of questions, have a relative or friend sit in on meetings and document their work with elderly clients.
