A bill was introduced Tuesday by Sen. Bob Casey, D-Pa., that is designed to curtail the widespread practice of worker misclassification, making it a violation of the Fair Labor Standards Act, and assigning penalties for all types of payroll fraud cases, particularly for the construction industry. "I think a lot of people would be stunned to learn that under current federal law it is not a violation of the Fair Labor Standards Act to engage in this kind of misclassification, this kind of fraud," Casey said. Misclassifying workers as independent contractors instead of as employees costs the federal government millions of tax dollars and workers are paid less and denied workers' compensation protection.
