DISH Network's ad-skipping Hopper DVR withstood another legal test after a federal appeals court denied Fox Broadcasting's second request for the court to put the service on hold while Fox's related lawsuit proceeds. The judges said that Fox has failed to show that its copyright and breach-of-contract claims would succeed. "This is a victory for American consumers, and we are proud to have stood by their side in this important fight over the fundamental rights of consumer choice and control," said DISH's R. Stanton Dodge.
