Florida state Rep. Jason Brodeur, R-Sanford, has sponsored a bill to overhaul the state's malpractice system using a model based partly on workers' compensation programs. The legislation calls for a panel of physicians to determine if a case led to "avoidable medical harm," with compensation determined by a set formula. The Florida Supreme Court recently found a 2003 law that limited malpractice awards was unconstitutional.
