A US District Court has ruled that contract arbitration between Hospital Builders and Bauguess Electrical Services over a project in Pennsylvania must occur in South Dakota, as the Federal Arbitration Act preempts the Pennsylvania Contractor and Subcontractor Payment Act. The court found a provision in the state law conflicted with the purpose of the federal law, which it said is to uphold the terms of private arbitration agreements.
