Florida construction subcontracts often contain clauses for contingent payments that in some cases are enforceable but only offer short-term protection to the general contractor, writes attorney Leonard Klingen. "Notwithstanding contrary language in a subcontract, an unpaid subcontractor retains the right to record a claim of lien and the right to claim against a payment bond," he writes.
