Federal court upholds EPA hazardous waste disposal rule

The US Court of Appeals for the District of Columbia Circuit sided with the Environmental Protection Agency in a case on Tuesday, upholding a "transfer-based exclusion" provision in the EPA's hazardous waste disposal rule. The provision allows the EPA to classify some transferred hazardous solid waste as recycled, exempting it from the requirements for "discards" under the Resource Conservation and Recovery Act.
