The European Securities and Markets Authority has recommended to policymakers that an EU-wide approach to cryptoassets be taken and that cryptoassets that qualify as financial instruments be subject to the revised Markets in Financial Instruments Directive. A bespoke regime could be established for cryptoassets that fall outside the scope of MiFID II, ESMA says.
