The US Court of Appeals for the 9th Circuit has reversed a Tax Court decision that a cost-sharing regulation that required allocation of stock-based compensation was invalid. The court had come to the same conclusion in July but withdrew the opinion because a judge on the panel deciding the case died before the opinion was issued.
