Companies that self-report to the Justice Department regarding bribery might receive leniency under the Foreign Corrupt Practices Act if they have policies prohibiting or restricting employees' use of ephemeral messaging apps such as Wickr and WhatsApp. Widespread use of such applications complicates the Justice Department's ability to conduct investigations, said Daniel Kahn of the department's FCPA unit.
