The legal opinion used by the Interior Department to roll back bird protections under the Migratory Bird Treaty Act is "contrary to law," ruled US District Judge Valerie Caproni on Monday. "The opinion freezes the MBTA in time as a hunting-regulation statute, preventing it from addressing modern threats to migrating bird populations," wrote Caproni, adding the opinion offers "an unpersuasive interpretation of the MBTA's unambiguous prohibition on killing protected birds."
